DIVISION OF POWER:

  • Schedule 7 of Indian Constitution. 
  • Central View will prevail in case of disagreement between state and central in the subject of concurrent lists.

SEPARATION OF POWER:

  • As legislature,execution and judiciary

India - Union and its territory:

  •     Union of india-> only States
  •     Territory of India-> Total territory of India where India's power exists.
  •     No of States and Union territory-> 28 States and 8 Union territory
  •    No Constitution amendments needed for creation of new States (joining two states etc.)

FUNDAMENTAL RIGHTS:

  •        Borrowed from  the US CONSTITUTION
  •   Basic set of rights of an individual.
  •        ARTICLE 12 -> Definition of States
  •        ARTICLE 13 -> Definition of judicial review
  •        Judiciary can declare any act of executive or legislature as void if it is unconstitutional
  •     Judiciary not absolute, not sacrosanct, inalienable

SIX FUNDAMENTAL RIGHTS:

  •        RIGHT TO EQUALITY(14-18)
  •        RIGHT TO FREEDOM(19-22)
  •        RIGHT TO FREEDOM OF RELIGION(25-28)
  •      RIGHT AGAINST EXPLOITATION(23-24)
  •      CULTURAL AND EDUCATIONAL RIGHTS(29-30)
  •        RIGHT TO CONSTITUTIONAL REMEDIES(32)
